If you do not show up on the Reservation date without having modified or canceled it as indicated in this clause, it will be considered a late cancellation and we may apply the penalty or retain the guarantee payment that we informed you of at the time of booking.
4. PRICE AND PAYMENT
4.1 Prices
The applicable prices are those indicated at any given time on the Website on the date the Reservation is made and include VAT and any other applicable indirect tax. We may update the prices at any time, but changes will not affect already confirmed Reservations.
If a tourist tax or fee is applicable, we will inform you of its amount before confirming the Reservation; unless otherwise indicated, it is paid directly at the establishment.
4.2 Payment Methods
To make a Reservation or contract a Service, you must provide a payment method. The Website may redirect you to third-party platforms to complete the payment of the Reservation by credit card or other available payment methods.

8.1 Intellectual and/or Industrial Property

Under no circumstances does the use of the Website or the contracting of the Services imply the transfer of any intellectual and/or industrial property rights over it or its contents.
8.2 Force Majeure
In the event of a fortuitous event or force majeure that prevents or delays the fulfillment of the Services, we may be obliged to suspend our obligations in whole or in part. In any case, the Terms of Use in effect at the time of each Reservation will apply, and no subsequent modification will affect Reservations already made.
8.4 Independence and Integrity of the Clauses
The illegality, invalidity, or ineffectiveness of any of the clauses that make up these Terms of Use will not affect the effectiveness of the rest, provided that the rights and obligations are not essentially affected. Such clauses shall be replaced or supplemented with others that, being in accordance with the law, fulfill the purpose of the replaced ones.
8.5 Applicable Law and Jurisdiction
Access to and use of https://www.bergaresort.com shall be governed by the provisions of Spanish law. Any dispute or controversy shall be resolved by the courts and tribunals of Berga with express waiver of any other jurisdiction that may correspond to you, except in the case where you are considered a consumer, in which case the courts and tribunals of your domicile shall have jurisdiction.
